Employers Liability

It's the Law.

Even with a single employee, you are required to arrange compulsory Employers Liability Insurance in accordance with the Employers Liability Compulsory Insurance Act 1969 in respect of accidents, illnesses or diseases contracted by their employees in the course of their work. Failure to do so is a criminal offence.

Is any business exempt from Employers Liability insurance?

If your business is not a limited company, and you are the only employee or you only employ close family members, you are exempt from arranging EL insurance. Limited companies with only a single director employee who owns 50 per cent or more of the issued share capital in the company, are also exempt from arranging EL insurance.

Whilst there are certain circumstances where you are not compelled to arrange EL insurance, it may be unwise to do so for several reasons; Your spouse or partner may be an director of your company and therefore an employee. You could take on temporary staff/help/labour or make a request for help in which the status of that request (in the eyes of the law) makes you an Employer.
