Even with a single employee, you are required to arrange compulsory Employers Liability Insurance in accordance with the Employers Liability Compulsory Insurance Act 1969 in respect of accidents, illnesses or diseases contracted by their employees in the course of their work. Failure to do so is a criminal offence.
Whilst there are certain circumstances where you are not compelled to arrange EL insurance, it may be unwise to do so for several reasons; Your spouse or partner may be an director of your company and therefore an employee. You could take on temporary staff/help/labour or make a request for help in which the status of that request (in the eyes of the law) makes you an Employer. If you are in any doubt as to whether you need to arrange EL insurance, please contact us and we will be happy to provide guidance on the issue. Downloads Available: |
